Terms of service
1. Introduction and acceptance
Hey, welcome to Miyukai! Before you load your cart for your next big adventure (or just a very good Tuesday), here are the ground rules we both agree to when you place an order. Not the fun part, but it keeps things fair for everyone.
By placing an order on this website, you agree to these Terms & Conditions, our Shipping Policy and our Returns & Refund Policy (together, the "Policies"). The Policies form part of this agreement and are read together as one agreement. The agreement is in English. In this agreement and the Policies, business days exclude Saturdays, Sundays, South African public holidays and any day on which we have told you, on this website, in your order confirmation or by email, that we are closed or not dispatching. This does not extend any period the law requires us to meet.
In these terms, "Miyukai", "we", "us" and "our" mean Ligum 18 (Pty) Ltd, trading as Miyukai. "You" means the person placing the order.
- The Shipping Policy sets out dispatch, delivery, delivery addresses, and transit damage and loss.
- The Returns & Refund Policy sets out returns, cancellations and refunds.
- Nothing in these terms or the Policies limits your rights under the Consumer Protection Act 68 of 2008 (CPA) or the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

Our premises are an office, not a retail store, and are not open to the public. We do not hold sellable stock there, so you cannot visit to browse or buy, and you may not arrive before we tell you that your order is ready for collection. You may collect an order from our premises only if every product in the order qualifies for pickup and you selected pickup at checkout. Pickup orders cannot be combined with shipped orders, and once an order has been paid for, the method of receipt cannot be changed. All other orders are delivered by courier. We do not accept in-person returns.
3. Orders, pricing and product information
Reviewing your order. Before you pay, the checkout shows your items, the full price, the shipping cost and the total. You can review the whole order, correct mistakes and withdraw from the transaction before you pay. After you order, we email you confirmation, which you may print or save.
Prices and currency. All prices are in South African Rand (ZAR) and include VAT. The shipping cost is shown separately before you pay.
Availability. All orders are subject to stock availability and payment clearance. If an item is unavailable, we cancel the order and start a full refund within 5 business days of cancelling.
Product information. We take care to describe our jewellery accurately. Colours can look a little different on different screens, and sizes and dimensions may vary slightly from the details we list.
Pricing errors. If a product is listed at an obviously incorrect price because of a clerical or supplier error, we may cancel an order for it at that price. We tell you promptly. If you have already paid, we start a full refund within 5 business days of cancelling the order.
Cancelling before dispatch. If you cancel a paid order before it is dispatched, we charge only the actual payment-processing cost we incur, up to a maximum of R50. This fee never applies to a cooling-off cancellation (section 6.1).
4. Payment and card security
You may pay on this website by:
- Visa, MasterCard, American Express or Diners Club card, including through Apple Pay, Google Pay or Samsung Pay; or
- a pay-later or credit option: Mobicred, Payflex or Float.
We do not accept EFT or cash.
Cards and wallets. Card payments are processed by a third-party payment gateway, either PayGate or Peach Payments, that works with South African acquiring banks. The gateway uses industry-standard encryption (SSL/TLS) and no card details are stored on this website. You enter your card details on the gateway's secure site, and we store your customer details separately from your card details. You can view the security certificate and policy of PayGate at www.paygate.co.za and of Peach Payments at www.peachpayments.com.
Pay-later options. Mobicred, Payflex and Float are independent providers. If you choose one, you apply to and agree with that provider directly. The provider decides whether to approve you and sets the repayment terms and charges, so please read its terms before you accept. We are not the credit provider. Your agreement with us is for the goods. If you cancel, return goods or receive a refund, we refund through the provider, who adjusts your balance or instalments, and how long that takes depends on the provider. Your rights to cancel and to a refund under these terms do not change because you paid this way.
The merchant outlet country when payment options are presented is South Africa. We take responsibility for all aspects of the transaction, including the sale of the goods, customer service and support, dispute resolution and delivery.
5. Shipping, delivery and risk
This is the quick version of our Shipping Policy, which has the full detail.
- Where we deliver. We deliver within South Africa through courier partners, and to neighbouring territories only by special arrangement agreed in writing before you pay (free shipping does not apply, and customs duties and import taxes are for your account). We check every delivery address after you order. If an address is unserviceable, or a courier applies a surcharge we cannot absorb, we contact you before dispatch to agree another arrangement. We do not charge a surcharge without your agreement. If we cannot agree an arrangement, we cancel the order and refund you in full.
- Pickup. Pickup is available only for orders where every product qualifies for pickup and pickup was selected at checkout. We email you when the order is ready and tell you how and when to collect it. Please do not arrive before then. Our premises are an office, not a shop, and we cannot serve walk-in visitors. Our Shipping Policy has the detail.
- Times. We usually dispatch within 1-3 business days of order confirmation and deliver within 2-10 business days after dispatch. These are estimates, not guarantees, and may be longer in peak periods. Business days are as defined in section 1.
- Costs. Shipping within South Africa is a flat R249, and free for orders over R999 including VAT, before shipping charges. Promotional shipping terms prevail for the duration of a promotion.
- Handover and tracking. We email you a tracking reference once your order is dispatched. Parcels need a signature or physical handover. Please inspect the parcel in the courier's presence and note any visible damage on the delivery document. A courier leaves a parcel unattended only if you request this in writing, for that delivery, directly with the courier, and send us a copy. If you do, the risk of theft, loss or damage passes to you once the parcel is left at your delivery location.
- Risk and ownership. Ownership of, and risk in, the goods pass to you when the parcel is delivered to your address and accepted by you or on your behalf. Until then our courier partners are responsible for the goods in transit. For a pickup order, ownership and risk pass to you when you collect it. We deal with the courier on your behalf and pursue claims for transit damage or loss.
- Delayed, lost or damaged parcels. If your order has not arrived within 10 business days of dispatch, email us with your order number and tracking reference. If we have not delivered within 30 days of receiving your order, you may cancel it by giving us 7 days' written notice, and we refund you in full within 30 days of cancellation. Please report transit damage or missing items within 7 calendar days of delivery, with photographs. We are responsible for our own picking, packing and invoicing errors and put them right at no cost to you. These reporting windows help us claim from the courier and do not limit your legal rights, including your rights for defective goods.
- Packaging. Check the outer packaging when the parcel is handed over, and keep all outer and inner packaging until you have checked the goods and, if you may return them, until your return period ends. Damage to packaging alone, such as a dented box, is not a defect. If the goods themselves are damaged, you may claim.
6. Returns, cancellations and refunds
Our Returns & Refund Policy has the full detail and forms part of this agreement. The short version:
- Cooling-off. You may cancel an online order within 7 calendar days of receiving the goods, without giving a reason. Return the goods in their original packaging, unused and in the condition you received them. You pay only the direct cost of returning them (and the cost of replacement packaging if the original is missing or damaged). We refund everything else within 30 days of your cancellation.
- Change of mind. Within 14 calendar days of delivery you may return an unused item in its original packaging for store credit, valid for 3 years. Return costs and any inspection or packaging costs are deducted. You must send date- and time-stamped photographs with your request, and we do not consider the return without them.
- Not returnable for change of mind. Hygiene items (earrings) and all discounted items (clearance, promotions and sale events such as Black Friday) are final sale. By buying them you acknowledge this. Your rights for defective, unsafe or incorrectly supplied goods still apply.
- Gift cards. Gift cards cannot be refunded or exchanged for cash, and are valid for 3 years from the date of issue.
- Defective, unsafe or incorrect goods. Every item carries a 6-month limited warranty from delivery. If goods are faulty, you may choose repair, replacement or a refund. This does not cover misuse, abuse, negligence, carelessness, mishandling, use against the instructions or care instructions, alteration, or assembly errors that were not ours.
- Refunds. Refunds go to your original payment method. For Mobicred, Payflex or Float, we refund through the provider, who adjusts your balance or instalments. When the money reaches you depends on your bank, the provider and our payment gateway.
- Goods sent back without notice. We do not process them as returns. We hold them for 30 days from the date we tell you in writing, and may dispose of them after a further 7 days' written notice, but never while a claim for them is open.
7. Privacy and personal information
Your info is yours, and we treat it that way. We take reasonable steps to protect it and handle it in line with the Protection of Personal Information Act 4 of 2013 (POPIA). We store your customer details separately from your card details, which you enter only on our payment gateway's secure site (section 4). How we collect, use and share personal information, and how you can exercise your rights, are set out in our Privacy Policy, available on this website.
8. Complaints
Something not right? Tell us first and we'll do our best to fix it. Email info@miyukai.com with your order number and we will respond as quickly as we can. If we cannot resolve it, you may approach the National Consumer Commission or the relevant consumer court.
9. Changes, governing law and general
Changes to these terms. We may update these Terms & Conditions and the Policies from time to time by publishing the new version on this website. The version in force when you place an order applies to that order. Changes do not affect orders already placed.
Governing law. This agreement is governed by the laws of South Africa.
Domicilium. Ligum 18 (Pty) Ltd chooses its physical address in section 2 as its domicilium citandi et executandi for court process, notices and other documents under this agreement.
Severability. If any provision of this agreement is found invalid or unenforceable, the remaining provisions stay in force.
Contact. Questions about these terms: info@miyukai.com.
